Terms of Service

These terms are an agreement between you and Arunava Das (“StayClose”, “we”, “us”), who operates the StayClose app and this site. By downloading, opening or using StayClose you accept them. If you do not accept them, please do not use the app.

Our Privacy Policy forms part of these terms.

StayClose is rated 17+ and contains suggestive themes and adult references. You must be at least 17 years old, and old enough to form a binding contract where you live, to use it.

You sign in with Google or Apple, and you are responsible for keeping that account secure. Everything done through your account is treated as done by you.

Pairing works by sharing a six-digit code. Once paired, your partner can see your name, your photo and everything you do in a shared game, so share your code only with the person you intend to play with. You can unpair, or delete your account entirely, from your profile at any time.

StayClose suggests questions, dares and challenges. Some decks are deliberately flirtatious or intimate. These are prompts, not instructions.

Nothing in the game overrides consent. You and your partner decide together what you are comfortable doing, and either of you can skip anything at any time. You are solely responsible for what you choose to do as a result of a prompt. Do not use StayClose to pressure, coerce or harass anyone.

StayClose is free to download. Individual prompt decks are one-time, non-consumable in-app purchases — buy a deck once and it stays unlocked on the store account you bought it with. Reinstalling the app and tapping Restore Purchase brings your decks back.

All payments are taken and processed by Apple or Google under their own terms, and we never see your payment details. Refunds are handled by Apple or Google, not by us — request one through the store you bought from. Prices vary by country and may change.

Decks are digital content delivered immediately, so your right to cancel may not apply once a deck is unlocked, to the extent the law allows.

The app, its design, its artwork and all of its prompts belong to us and are protected by copyright and other laws. We grant you a personal, non-transferable, revocable licence to use StayClose on devices you own or control. Everything not expressly granted is reserved.

The wishes and text you write remain yours. You grant us only the permission needed to store them and show them to the partner you paired with.

StayClose is provided “as is” and “as available”. Real-time play depends on both devices having a working internet connection. We do not promise the service will be uninterrupted or error-free, or that any particular deck or feature will remain available, and we may change or discontinue features.

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential losses, for lost data, or for anything you or your partner choose to do as a result of using the app. Our total liability for any claim relating to StayClose is limited to the amount you paid us in the twelve months before the claim.

Nothing here excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep your statutory rights.

You can stop using StayClose at any time by deleting your account in the app. We may suspend or end your access if you break these terms. Sections that by their nature should survive termination — intellectual property, disclaimers, liability — do.

These terms are between you and us, not Apple, and Apple is not responsible for StayClose or its content.

Apple has no obligation to provide maintenance or support for StayClose. If the app fails to conform to any warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the app, including product liability, legal or regulatory non-compliance, or consumer protection claims, nor for any third-party claim that the app infringes intellectual property rights.

You confirm you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government list of prohibited or restricted parties.

Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

We may update these terms. When we do, we will change the date at the top, and for significant changes we will tell you in the app. Continuing to use StayClose after a change means you accept the updated terms.

These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute. If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country you live in.
